(New Contest Format starting August 2006)

SUMMARY OF RULES FOR CURRENT CONTEST

Duration of contest - Approximately 1 calendar month (Contest will end within 2 days of calendar month)
Eligibility - RadioIndy.com Gold Artists, except RadioIndy owners and employees.
Cost - There is no cost to enter or vote in the current contest.
Who Wins?
- The contest is won by the artist in the contest that has the most listeners who select them as their favorite artist on RadioIndy.com during the contest.
Prizes - The band in the current contest with the most votes (the winner) receives the following prizes:
- up to $100 USD ($1 per vote they receive up to $100 maximum).
- Exposure on Radioindy.com and in our Listener Newsletter to over 5000 listeners.
- Announcement on RadioIndy.com home page.
How to vote - Fill out the form from the link to vote on contest page next to artist. Only 1 vote/fan is permitted. Fans can change their vote. Only the last vote will count in the final vote tally.
Disqualification - RadioIndy.com retains the right to remove any artist or fan from the contest at any time, if it suspects that the artist or fan is cheating, which in this contest includes creating multiple emails so as to vote multiple times for the same artist.
If an email address of a fan bounces or if the fan unsubscribes during the contest, the vote is not counted.
(In this contest more than 1 vote and/or email per person (listener or artist) = cheating.)
(In this contest artists are not allowed to vote more than 1 time for themselves.)



Detailed Contest Rules

From time to time, RadioIndy will sponsor contests that will be introduced by contest announcements. The following rules are intended to supplement provisions contained within the individual competition announcements, as well as the Terms of Service and Artist Agreement.

SECTION ONE -- ELIGIBILITY REQUIREMENTS

1.1 Eligibility
Competition is open to amateur and professional artists throughout the world who have earned less than $1,000,000 USD in aggregate song royalties in the past year.

1.2 Persons Not Eligible
Employees and owners of MikVacch Enterprises, their families, subsidiaries, and affiliates are not eligible to win contests.

SECTION TWO -- SUBMISSIONS

2.1 Entrance Fees
The contest announcement will indicate if there is a fee to enter contest.

2.2 Form of Submissions
Any song that is on RadioIndy.com that is the contestant’s original work will be considered for a contest unless otherwise stated in the rules for a specific contest. In some contests, only songs that have been reviewed by RadioIndy.com and names Gold songs will be eligible.

2.3 Co-contestants
Collaborative work is accepted, but all prizes will be awarded to the email address on the artist account for RadioIndy.com. Division of prizes among co-contestants is the sole responsibility of winners.

2.4 Winner Selection if Determined by Voting and/or Rating
The at-large public will have the opportunity to vote for songs during the competition. These winners will be selected via an online poll. Winners may also be chosen by an online ratings system where the public rates songs as they hear them, and those ratings are calculated to obtain an average rating. The methodology for this rating and averaging system will be at the sole discretion of RadioIndy.com. The contestant whose submission receives the most qualified votes online shall be declared the winner of the online poll. RadioIndy.com may from time to time set forth qualifications for vote and voters. Only those votes that meet the qualifications will be counted for the purposes of determining the winning songs.

2.5 Ties
In the event of a tie, RadioIndy.com reserves the right to extend the competition to break the tie and establish a clear winner. RadioIndy.com may employ any means it deems reasonable, at its sole discretion, to resolve the tie, including, but not limited to, conducting another competition.

2.6 Winner Notification
Winners will be notified by the email address provided in their RadioIndy.com account or otherwise provided to RadioIndy.com.

2.7 Acknowledgment of Proprietary Rights
Contestants retain all rights to their songs and lyrics.

2.8 Fraud
RadioIndy.com reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the competition or to be acting in violation of the Official Rules or in an unsportsmanlike or disruptive manner. Moreover, any attempt by any person to deliberately damage RadioIndy.com’s web site or undermine the legitimate operation of the competition may be in violation of criminal and civil laws and, should such an attempt be made, RadioIndy.com reserves the right to seek damages from any such person to the fullest extent permitted by law. RadioIndy.com’s failure to enforce any term of the Official Rules shall not constitute a waiver of this provision.

SECTION THREE – PRIZES AND ODDS

3.1 Prizes / Odds
The odds of winning will depend on the number of eligible entries received. Prize Winners will receive the prizes as set forth in the competition announcement. In the event a prize is not available due to circumstances beyond the control of RadioIndy.com, RadioIndy.com reserves the right to provide a substantially similar substitute prize that RadioIndy.com deems to be of greater or equal value.

3.2 Taxes
Winning contestants are solely responsible for all federal, state, and local taxes and fees associated with prize receipt and use. RadioIndy.com will withhold and report taxes as required by law.

SECTION FOUR -- GENERAL INFORMATION RULES

4.1 Terms and Conditions Binding
RadioIndy.com artists agree to be bound by the rules of this competition and the decisions of the panel of judges, ratings, or tally of the online votes, which shall be final and binding. Entry also constitutes permission to use contestants’ names, likenesses, and voices for future advertising and publicity purposes without additional compensation.

4.2 Cancellation of Competition
RadioIndy.com reserves the right to cancel the competition if fraud, technical failures or any other factor beyond RadioIndy.com’s reasonable control impairs the integrity of the competition, as determined by RadioIndy.com in its sole discretion.

4.3 Modification of Terms
RadioIndy.com reserves the right to extend, at its discretion, the end date of a competition up to sixty additional days. Any changes in end dates will be posted on the web site.

4.4 Disclaimer of Liability
RadioIndy.com and its parent company, MikVacch Enterprises, LLC, affiliates, subsidiaries, directors, officers, employees, licensees/licensors, representatives and agents, disclaims any and all liability whatsoever for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the competition or with the acceptance, possession or use of any prize (including, without limitation, claims, costs, injuries and losses related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light).

4.5 Release of Liability
Except where prohibited by law, RadioIndy.com artists in contests release RadioInyd.com and its parent company, MikVacch Enterprises, LLC, affiliates, subsidiaries, licensees/licensors, directors, officers, employees, representatives and agents, from any and all claims, actions, injury, loss or damage of any kind resulting from or arising directly or indirectly out of each contestant’s participation in this competition and/or from the acceptance or use of the prize awarded.

4.6 Governing Law
Void where prohibited. The laws of the State of Arizona and the United States of America apply to and govern this competition, including but not limited to any applicable taxes for prizes. Except where prohibited, participants agree that any and all disputes, claims and causes of action arising out of or connected with the competition shall be resolved exclusively by arbitration pursuant to the Rules of the American Arbitration Association then effective, and any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred by participant with regard to the competition, but no attorneys’ fees, punitive, incidental, consequential or other damages.

Any claims or actions in connection herewith must be brought in Arizona. Rules and regulations are subject to change at RadioIndy.com’s discretion.

4.7 Severability
If any portion of these competition rules is deemed void or unenforceable, then that portion shall be deemed severable from these competition rules and shall not affect the validity and enforceability of the remaining provisions.
